General Terms and Conditions (AGB) for the holiday accommodations Villa Heidi, Haus Siggi and Ferienhaus Sauerzapf Landlord: Gunnar Sauerzapf-Sauerzapf GbR, Villa Heidi Herzog- Johann-Albrecht- Str. 13, House Siggi Herzog-Johann-Albrecht-Str. 15, Holiday home Sauerzapf Herzog-Johann-Albrecht-Str. 17 in 38700 Braunlage. 1. arrival / departure Departure must be no later than 10:00 am on the day of departure. Other arrival and departure times can be arranged individually with the landlord. If the tenant does not show up by 10 p.m. on the day of arrival, the contract is deemed to be terminated immediately without notification to the landlord. The landlord can then freely dispose of the property. A (pro-rata) repayment of the rent due to premature departure will not be made. In the case of overnight stays by persons not belonging to the tenant (visitors), the number of visitors and the length of stay must be indicated to the landlord before arrival. The rental costs may possibly increase. 2. payment The rental agreement becomes valid upon receipt of payment to the account of the landlord. The full amount is payable within 14 days of booking. If the payment deadlines are not met, the landlord can withdraw from the contract. The non-payment is considered as withdrawal and entitles to a new rental. The total amount stated in the rental contract includes the additional costs (water, energy, final cleaning, waste, GEZ = 7% VAT). 3. rescission You can withdraw from the contract at any time. The withdrawal must be in writing (letter or email). In case of withdrawal you are obliged to compensate us for the damage we have suffered. The amount is based on the legal regulations. In the event of withdrawal less than eight days before the start of the rental period, the full travel price is to be paid. The date of receipt of your notice of withdrawal is always the relevant date. Amounts already paid will be charged. A replacement person who will enter your contract under the conditions mentioned above can be provided by you. A written notification is sufficient. 4. duties of the tenant The tenant undertakes to treat the rented property (holiday home, inventory and outdoor facilities) with care. If damage to the holiday home and/or its inventory occurs during the rental period, the tenant is obliged to notify the landlord immediately. Defects and damage already noticed on arrival must be reported immediately (by 8 pm on the day of arrival). must be reported to the property management, otherwise the tenant is liable for these damages. A reasonable period of time must be allowed for the repair of damage and defects. Claims arising from complaints that are not reported immediately on site are excluded. Complaints that are only received by the landlord at the end of the stay or after leaving the holiday home are also excluded from compensation. In the event of any disruptions to services, the tenant is obliged to do everything reasonable within the scope of his legal obligation to contribute to the rectification of the disruption and to keep any damage caused to a minimum. On the day of departure, personal items must be removed by the tenant, household waste must be disposed of in the containers provided, dishes must be stored in the kitchen cupboards in a clean and washed state. The property is to be left free of waste. Subletting of the property by the tenant or overnight stay(s) of persons not belonging to the tenant in the holiday home and/or on the property without the knowledge of the landlord is generally not permitted (see also point 1). Contraventions lead to immediate termination of the rental agreement by the Lessor and the object must be left immediately. If the tenant has forgotten personal belongings and does not contact the landlord, the objects left behind will be destroyed after a storage period of 6 months after departure. It is strictly forbidden to charge electric cars on the power supply system of the holiday home. The cross-sections of the cables are not designed for this. There is an e-charging station within a radius of 500m. 5. pets Not allowed. 6. data protection The renter agrees that within the scope of the contract concluded with him/her, necessary data about his/her person will be stored, changed and/or deleted. All personal data will be treated with absolute confidentiality and will not be passed on to third parties. The renter has the right to object to the storage of his data at any time. The deletion will take place within a reasonable period of time, if there are no legal requirements (e.g. from a tax point of view) to the contrary.7. liability The invitation to tender was drawn up to the best of our knowledge. We are not liable for any influence on the rented property due to force majeure, customary power and water failures and storms. Similarly, no liability is accepted in the event of unforeseeable or unavoidable circumstances such as official orders, sudden construction site or for disturbances caused by natural or local conditions. However, the lessor will be happy to assist in solving the problems (as far as this is possible). The lessor is not liable for the use of the provided play and sports equipment. The arrival and departure of the tenant is at his own responsibility and liability. The landlord is not liable for personal items in case of theft or fire. In this respect the tenant waives any claims for damages. The tenant is fully liable for wilful destruction or damage. 8. final provisions Photos and text on the website or in the flyer serve as realistic descriptions. We cannot guarantee 100% conformity with the rental property. The landlord reserves the right to make changes to the equipment (e.g. furniture), provided that they are equivalent. Should one or more provisions of these terms and conditions be or become invalid, this shall not affect the validity of the remaining provisions. The ineffective provision shall be replaced by an effective provision which comes closest to the economic and legal intention of the contracting parties. German law applies. Place of jurisdiction and place of performance is the place of residence of the lessor.
